Current treatments of cultural heritage as an object of moral concern (whether it be the heritage of mankind or of some particular group of people) have tended to treat it as a means to ensure human wellbeing: either as ‘cultural property’ or ‘cultural patrimony’, suggesting concomitant rights of possession and exclusion, or otherwise as something which, gaining its ethical significance from the roles it plays in people’s lives and the formation of their identities, is the beneficiary at most of indirect (...) moral obligations. In contrast, I argue that cultural heritage, as something whose existence can go well or badly, can itself qualify as a moral patient towards which we may have obligations which need not be accounted for in terms of subsequent benefits to human beings. Drawing inspiration from environmental ethics and suggesting that heritage, like an ecosystem, is a complex network of interrelations which invites a holistic understanding, I develop a framework for thinking about cultural heritage which shows how such a thing can feature in our ethical reflections as intrinsically worthy of respect in spite of its most obvious differences from the ‘natural’ world: the very human origins of cultural heritage and its involvement with human life in all its forms. As part of the development of this framework I consider the epistemic difficulties which arise when for all our holistic sophistication we do find ourselves in the predicament of having to judge the moral worth of some item of heritage, possibly someone else’s heritage and possibly something which we find ourselves disposed to value more because of than despite any mysteries surrounding it. I conclude by offering some tentative illustrations of how such a framework might operate in the practical course of normative moral reasoning about what should be done with items of cultural heritage. -/- [Erratum note: p. 30 conflates the Kumasi palace looting of 1874 with that of 1896.]. This goal is accomplished by an examination of three essays that Northrop penned over a (...) period of 14 years. Although a few critical remarks are tendered, my essay tends to be descriptive in an effort to introduce those unfamiliar with Northrop to the work of this vast mind. We discuss the case against Factorism, which is the standard assumption in quantum mechanics that the labels of the $$\otimes$$ ⊗ -factor Hilbert-spaces in direct-product Hilbert-spaces of composite physical systems of similar particles refer to particles, either directly or descriptively. We distinguish different versions of Factorism and argue for their truth or falsehood. In particular, by introducing the concepts of snapshot Hilbert-space and Schrödinger-movie, we demonstrate that there are Hilbert-spaces and $$\otimes$$ ⊗ -factorisations where the labels do refer, even descriptively, (...) to similar particles, which renders them probabilistically absolutely discernible. In his 2009 PSA Recent Ph.D. Award winning contribution to the bi-annual PSA Conference at Pittsburgh in 2008, C. Wu ̈thrich mounted an argument against struc- turalism about space-time in the context of the General Theory of Relativity, to the effect that structuralists cannot discern space-time points. An “abysmal embarrass- ment” for the structuralist, Wu ̈thrich judged. Wu ̈thrich’s characterisation of space-time structuralism is however incorrect. We demonstrate how, on the basis of a correct char- acterisation of space-time structuralism, it (...) is possible to discern space-time points in the GTR-structures under consideration. Thus Wu ̈thrich’s argument crumbles. (shrink)

The notorious ‘measurement problem’ has been roving around quantum mechanics for nearly a century since its inception, and has given rise to a variety of ‘interpretations’ of quantum mechanics, which are meant to evade it. We argue that no less than six problems need to be distinguished, and that several of them classify as different types of problems. One of them is what traditionally is called ‘the measurement problem’. Another of them has nothing to do with measurements but is a (...) profound metaphysical problem. We also analyse critically Maudlin’s (Topoi 14:7–15, 1995) well-known statement of ‘three measurements problems’, and the clash of the views of Brown (Found Phys 16:857–870, 1986) and Stein (Maximal of an impossibility theorem concerning quantum measurement. In: R. S. Cohen et al. (Eds.), Potentiality, entanglement and passion-at-a-distance, 1997) on one of the six measurement problems. Finally, we summarise a solution to one measurement problem which has been largely ignored but tacitly if not explicitly acknowledged. (shrink)

The chronic worldwide lack of organs for transplantation and the continuing improvement of strategies for in situ organ preservation have led to renewed interest in elective non-therapeutic ventilation of potential organ donors. Two types of situation may be eligible for elective intensive care: patients definitely evolving towards brain death and patients suitable as controlled non-heart beating organ donors after life-supporting therapies have been assessed as futile and withdrawn. Assessment of the ethical acceptability and the risks of these strategies is essential. (...) We here offer such an ethical assessment using the four principles of medical ethics of Beauchamp and Childress applying them in their broadest sense so as to include patients and their families, their caregivers, other potential recipients of intensive care, and indeed society as a whole. The main ethical problems emerging are the definition of beneficence for the potential organ donor, the dilemma between the duty to respect a dying patient's autonomy and the duty not to harm him/her, and the possible psychological and social harm for families, caregivers other potential recipients of therapeutic intensive care, and society more generally. Caution is expressed about the ethical acceptability of elective non-therapeutic ventilation, along with some proposals for precautionary measures to be taken if it is to be implemented. (shrink)

Researchers have identified the phenomena of moral distress through many studies in Western countries. This research reports the first study of moral distress in Iran. Because of the differences in cultural values and nursing education, nurses working in intensive care units may experience moral distress differently than reported in previous studies. This research used a qualitative method involving semistructured and in-depth interviews of a purposive sample of 31 (28 clinical nurses and 3 nurse educators) individuals to identify the types of (...) moral distress among clinical nurses and nurse educators working in 12 cities in Iran. A content analysis of the data produced four themes to describe the nurses’ moral distress. The four themes were as follows: (a) institutional barriers and constraints; (b) communication problems; (c) futile actions, malpractice, and medical/care errors; (d) inappropriate responsibilities, resources, and competencies. The results demonstrate that moral distress for intensive care unit nurses is different and that the nursing leaders must reduce moral distress among nursing in intensive care. (shrink)

The guiding principle of the Model Revolution is: \emph{a scientific theory is a set of structures in the domain of discourse of axiomatic set-theory}, characterised by a set-theoretical predicate. We expound some critical reflections on the Model Revolution; the conclusions (...) will be that the philosophical problem of what a \emph{scientific theory} is has \emph{not} been solved yet --- \emph{pace} P.\ Suppes. While reflecting critically on the Model Revolution, we also explore a proposal of how to complete the Revolution and briefly address the intertwined subject of \emph{scientific representation}, which has come to occupy center stage in philosophy of science over the past decade. Hayek's substantial contribution to theoretical psychology has been addressed in the work of Thomas Szasz, Gerald Edelman, and Joaquin Fuster.

We maximally extend the quantum‐mechanical results of Muller and Saunders ( 2008 ) establishing the ‘weak discernibility’ of an arbitrary number of similar fermions in finite‐dimensional Hilbert spaces. This confutes the currently dominant view that ( A ) the quantum‐mechanical description of similar particles conflicts with Leibniz’s Principle of the Identity of Indiscernibles (PII); and that ( B ) the only way to save PII is by adopting some heavy metaphysical notion such as Scotusian haecceitas or Adamsian primitive thisness. The general context of this paper is the locality problem in quantum theory. In a recent issue of this journal, Redei (1991) offered a proof of the proposition that algebraic Lorentz-covariant quantum field theory is past stochastic Einstein local. We show that Redei's proof is either spurious or circular, and that it contains two deductive fallacies. Furthermore, we prove that the mentioned theory meets the stronger condition of stochastic Haag locality.

The use of human fetal tissue for scientific research has enormous potential but is subject to government legislation. In the United Kingdom the Polkinghorne Committee's guidelines were accepted by the Department of Health in 1990. These guidelines set out to protect women undergoing termination of pregnancy from exploitation but in so doing may significantly restrict potential research. Although the committee took evidence from a wide variety of experts they did not seek the views of the general public. We asked 108 (...) women about to have a therapeutic abortion; 167 women who had had a pregnancy terminated in the past, and 419 women who had never had an abortion, their views on research using human fetal tissue. Regardless of their past experiences the women were overwhelmingly in favour of research using fetal tissue (94 per cent). They made little distinction between basic research and research with obvious clinical relevance and supported the concept of using transplanted fetal tissue for the treatment of adult disease such as Parkinsonism. Women about to undergo an abortion were significantly more likely (p < 0.001) to approve of all types of research including that aimed at improving methods of abortion and research using live fetuses in utero. Over the past years, in books and journals (this journal included), N. Maxwell launched a ferocious attack on B. C. van Fraassen’s view of science called Constructive Empiricism (CE). This attack has been totally ignored. Must we conclude from this silence that no defence is possible and that a fortiori Maxwell has buried CE once and for all? Or is the attack too obviously flawed as not to merit exposure? A careful dissection of Maxwell’s reasoning will make it clear that (...) neither is the case. This dissection includes an analysis of Maxwell’s ‘aberrance–argument’ (omnipresent in his many writings) for the claim that science implicitly and permanently accepts a substantial, metaphysical thesis about the universe, which then paves the way for his own metaphysical-realist hierarchy-view of science. This aberrance-claim, which Maxwell directs against a widely shared and harmful ideology of science called ‘Standard Empiricism’, generally has been ignored too, for more than a quarter of a century. Our conclusions will be that (i) Maxwell’s attacks on CE can be beaten off, and (ii) his ‘aberrance–arguments’ do not establish what Maxwell believes they establish, but (iii) we can draw a number of valuable lessons from these attacks about the nature of science and of the libertarian nature of CE. Alan Musgrave, Michael Friedman, Jeffrey Foss, and Richard Creath raised different objections against the Distinction between observables and unobservables when drawn within the confines of Bas C. van Fraassen's Constructive Empiricism, to the effect that the Distinction cannot be drawn there coherently. Van Fraassen has only responded to Musgrave but Musgrave claimed not to understand van Fraassen's succinct response. I argue that van Fraassen's response is not enough. What remains in the end is an unsolved problem which CE cannot afford (...) to leave unsolved, or so I argue; I then strengthen Musgrave's criticism and indicate that an extension of the epistemic policy of CE is mandatory to solve the problem. I also argue that Friedman's and Foss' objection against the Distinction in CE misses the mark on closer inspection. An objection due to Creath does hit the mark but can be taken care of without too much ado. All these objections seem alive and kicking until the present day; I try to put them all to rest. (shrink)

L'étude aborde la question de la méthode théologique, en considérant sa nature et sa typologie, ses possibilités et ses limites, ainsi que les conditions de sa légitimité devant les instances du «depositum fidei». On attribue une importance spéciale à la tension de fond entre l'usage de la méthode kérygmatique et de la méthode dialogale dans la théologie du passé, mais surtout dans le débat actuel, spécialement entre divers courants de la théologie de la transcendance, telles les «théologies de la parole» (...) et la «méthode de corrélation», ou encore entre les «théologies du mystère» et la «méthode transcendantale». Pareille tension s'aggrave dans les «théologies de l'immanence», telles les théologies de la «mort de Dieu» ou les «théologies de l'histoire», ou entre les «théologies de la modernité» et certaines «théologies de la praxis». A la fin de ce panorama du pluralisme méthodologique actuel, on formule certains principes fondamentaux sur le problème débattu. Finalement, on considère le caractère obligatoire du «depositum fidei» comme instance théologique définitive. (shrink)

La «question de l'Inconditionné» est développée par Paul Tillich dans une Religionsphilosophie pensée comme Logique de la raison religieuse et comme Théorie du sens, dans une perspective théonome. La présente étude analyse le projet du premier Tillich, après l'avoir situé en relation au paradigme de la Modernité. Tillich mène un double combat, face à l'«hybris religieuse» de l'hétéronomie et à l'«hybris culturelle» de la pure autonomie. Partant de la tension fondamentale entre identité mystique et différence éthique, le projet de Tillich (...) souligne l'aspect paradoxal et dialectique de la religion, son vouloir d'atteindre le contenu inconditionné à travers des formes conditionnées, sa résistance à être pur objet et concept d'une science. Dépassant le paradigme de la Modernité, Tillich construit une Philosophie de la Religion située dans le système des sciences, mais non fondée sur le conditionné, mais au contraire sur l'Inconditionné. Les éléments et catégories du religieux sont soumis à l'analyse à travers un processus méthodologique complexe, critique et dialectique, intuitif et vital; est ainsi formulée l'unité de sens entre le fondé, le fondant et le fondement ultime qui soutient tout. La dialectique du sacré et du profane, du divin et du démoniaque, de la foi et de l'incrédulité, de Dieu et du monde, est éclairée dans la perspective théonome; d'où est surpassée la pure autonomie, en lutte avec l'hétéronomie religieus. One of the reasons provided for the shift away from an ontology for physical reality of material objects & properties towards one of physical structures & relations (Ontological Structural Realism: OntSR) is that the quantum-mechanical description of composite physical systems of similar elementary particles entails they are indiscernible. As material objects, they 'whither away', and when they wither away, structures emerge in their stead. We inquire into the question whether recent results establishing the weak discernibility of elementary particles pose a (...) threat for this quantum-mechanical reason for OntSR, because precisely their newly discovered discernibility prevents them from 'whithering away'. We argue there is a straightforward manner to consider the recent results as a reason in favour of OntSR rather than against it. (shrink)

We ponder the question whether quantum physics has had any influence on philosophy, and if not, whether it ought to have had any. Answers to these questions are provided, and they turn out to depend on which branch of the tree of philosophy we sweep, sway and swing, and even which twig of the branch we touch when we sweep, sway and swing.
